Using trademarks in domain names in UAE

I would like to know the rules of trademarks regarding the  domain names in UAE.

A trademark is a name, logo or device that is used to identify a product or service that differentiate it from other competitors. A Domain name is more than an address, as this is  closely associated with a specific product or service. But not all domains will not be eligible for trademark protection as these generic domain names are generally not considered trademarks.

The domain names that are involved in trademarks:-

  • There should be a need for the domain names that are used for the sale of goods and services.

  • When a trademark protects a domain name, there is a need for rights to prohibit others from using a similar or misspelled name.

The UAE Should have a comprehensive set of laws and regulations to protect brand owners and their intellectual property. The reason to register a trademark is to ensure that no one can use your trademark name without your permission. If the domain name is registered in a trademark, then the  URL should be protected by trademark law. If there is a  similar domain, then it can be used legally to prevent them from using your brand. By protecting the domains with trademarks it controls the online image on it. In accordance with the trademarks laws, if there is any unauthorized use of the marks can lead to confusion or the error of prohibition. Trademark owners can take legal action against anyone who can use their mark without permission, including the usage of the domain name. If trademark owners can prove that they infringed, they can be entitled to damages and other remedies under the law.

In summary, the use of a trademark in a domain name is generally cannot permitted in the UAE if it violates the rights of the trademark owner. It is important to conduct a trademark search and obtain permission from the trademark owner by using the trademark in a domain name.

The UAE Trademark Law governs trademark protection in the United Arab Emirates (UAE) (Federal Law No. 37 of 1992, as amended by Federal Law No. 8 of 2002). This law lays forth the guidelines and requirements for the registration and defence of trademarks in the United Arab Emirates, including those about domain names. In the UAE, trademarks may be registered for both goods and services. The UAE Ministry of Commerce, which oversees the UAE Trademark Law, is in charge of the registration procedure. Any distinctive sign, symbol, or expression used to distinguish a good or service is referred to as a trademark, and this includes words, logos, slogans, and graphics. If a domain name is used to identify a certain good or service and if it satisfies the requirements for trademark protection, it can be regarded as a trademark.

A domain name must be distinctive, unregistered by another party, and not against the law or morality to be registered as a trademark. The owner of a domain name may file a lawsuit to defend their rights if it is the same as or confusingly similar to a registered brand. This can entail submitting a formal complaint to the appropriate agencies or starting a judicial case. Although it is possible to register a domain name independently of a trademark registration, doing so is typically not recommended because doing so will help you protect your brand and stop others from using it. In the United Arab Emirates, trademark use is legally protected, and trademark owners have the power to forbid the unauthorised use of their marks.

Trademarks are defined as a signifier to distinguish the services or products of one company from others. In terms of UAE, as per the Federal Decree-law, a trademark can be anything from letters, words, graphical connotations, patterns or even voices related to a service/product. Like trademarks, domain names must also be given equal importance and should be registered so that nobody else can attain the same name.


‘.ae’ is the most common domain in UAE! In UAE, aeDA is the agency responsible for managing all types of domains and their operations. aeDA has various policies against plagiarizing domains and similar disputes, such as higher similarities of trademarks, dishonest use of the trademarked domain name, etcetera.

A trademark is a sign or indicator used by an business ,individual, organization or other legal entity to help consumers to identify that its products or services with which the trademark appears originate from a unique source, and help to distinguish  its products or services from those of other entities.


a trademark is typically a name, word, phrase, logo, symbol, fesign image, or a combination of these elements. A trademarks provides protection to the owner of the  mark by ensuring the exclusive right to use it to identify goods or services. Trade mark protection also hinders the efforts of the unfair competitors. The owner of the registered trademark may initiate legal proceedings for trade mark infringement to prevent unauthorized use of that trademark.


A trademark registered in the UAE has a validity of 10 years, after which is must be renewed for an additional cost. That registering your trademark only protects it in the seven emirates of the UAE, and not anywhere in the world.

A trademark is a graphic signifier of the company's products or services. It can be any words, phrases, symbols, designs, or a combination of these things that identifies your goods or services. Mainly using the trademark symbols are ™, SM & ®. After a trademark registration’s validity is over, you will have three months from the date of expiry to renew the registration or delad the renewal you will need to pay AED 1,000 as a fine. 


Limitations of Trademark Registration 


Shouldn't be offensive against public morals and religions.

Should not contain public symbols

Cannot be used Red Cross & Red Crescent symbols

Names or titles of third parties cannot be used.

Direct translations of other well-known trademarks are also not allowed

The ministry of Economy of the united Arab Emirates is the official body responsible for trademark registration. In the report of Article 3 of the federal law No 37 of 1992, it is started whether the public law is violated. marks Act does not treat trademark.

A trademark that is identical to or confusingly similar to an existing brand may not be used in a domain name unless the trademark owner has given their consent, according to UAE trademark law. Even if the trademark is registered in a foreign nation, this still holds true.

An international procedure known as the UDRP is used to settle disagreements over domain names that are identical to or confusingly similar to registered trademarks. If a trademark owner files a complaint under the UDRP and it is determined that their rights are being violated, the domain name may be reassigned to the trademark owner.
